Title IX

The U.S. Department of Education’s Office for Civil Rights (OCR) enforces, among other statutes, Title IX of the Education Amendments of 1972. Title IX protects people from discrimination based on sex in education programs or activities that receive Federal financial assistance. Title IX states that: No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.

Title IX applies to institutions that receive federal financial assistance from ED, including state and local educational agencies. These agencies include approximately 16,500 local school districts, 7,000 postsecondary institutions, as well as charter schools, for-profit schools, libraries, and museums. Also included are vocational rehabilitation agencies and education agencies of 50 states, the District of Columbia, and territories and possessions of the United States.
 
Educational programs and activities that receive ED funds must operate in a nondiscriminatory manner. Some key issue areas in which recipients have Title IX obligations are: recruitment, admissions, and counseling; financial assistance; athletics; sex-based harassment; treatment of pregnant and parenting students; discipline; single-sex education; and employment. Also, a recipient may not retaliate against any person for opposing an unlawful educational practice or policy, or made charges, testified or participated in any complaint action under Title IX. For a recipient to retaliate in any way is considered a violation of Title IX. The ED Title IX regulations (Volume 34, Code of Federal Regulations, Part 106) provide additional information about the forms of discrimination prohibited by Title IX.

A student, parent, guardian, employee, individual, or organization may file a Title IX complaint using the District’s Uniform Complaint Procedure (UCP) process by sending a complaint to the Title IX Coordinator listed above.

221.8. The following list of rights, which are based on the relevant provisions of the federal regulations implementing Title IX of the Education Amendments of 1972 (20 U.S.C. Sec. 1681 et seq.), may be used by the department for purposes of Section 221.6: (a)  You have the right to fair and equitable treatment and you shall not be discriminated against based on your sex. (b)  You have the right to be provided with an equitable opportunity to participate in all academic extracurricular activities, including athletics.  (c)  You have the right to inquire of the athletic director of your school as to the athletic opportunities offered by the school. (d)  You have the right to apply for athletic scholarships. (e)  You have the right to receive equitable treatment and benefits in the provision of all of the following: (1)  Equipment and supplies. (2)  Scheduling of games and practices. (3)  Transportation and daily allowances. (4)  Access to tutoring. (5)  Coaching. (6)  Locker rooms. (7)  Practice and competitive facilities. (8)  Medical and training facilities and services. (9)  Publicity. (f)  You have the right to have access to a gender equity coordinator to answer questions regarding gender equity laws. (g)  You have the right to contact the  State Department of Education and the California Interscholastic Federation to access information on gender equity laws. (h)  You have the right to file a confidential discrimination complaint with the United  States Office of Civil Rights or the State Department of Education if you believe you have been discriminated against or if you believe you have received unequal treatment on the basis of your sex.  (i)  You have the right to pursue civil remedies if you have been discriminated against. (j)  You have the right to be protected against retaliation if you file a discrimination complaint.  (Added by renumbering Section 271 by Stats. 2015, Ch. 43, Sec. 3.  (AB 1538)  Effective January 1, 2016.

Federal Title IX of the Education Amendments of 1972 (“Title IX”), implemented at 34 C.F.R. § 106.31, subd. (a), provides that no person shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any academic, extracurricular, research, occupational training, or other education program or activity operated by a recipient which receives federal financial assistance. Relevant here, Title IX requires school districts to take immediate and appropriate action to investigate when it knows or reasonably should know of a possible Title IX violation.

The federal regulations on Title IX require each covered school district or educational service agency to make “publicly available” on their websites all “materials used to train Title IX Coordinators, investigators, decision-makers, and any person who facilitates an informal resolution process.” Please note that the license granted for access to these materials is limited to public access for informational purposes only and does not include the right to use such materials for training purposes.
